Terms of Use

1. Eligibility

To use the Services, you must be at least 16 years of age. By using the Services, you represent and warrant that you are at least 16 years old, that you have the legal capacity to enter into a binding contract, that no applicable law prohibits you from using the Services, and that the information you provide to us is accurate and complete. If you use the Services on behalf of a company or other organization, you represent that you are authorized to bind it to these Terms, and “you” then refers to that organization.

2. Description of the Services

AI, But Simple is an AI-focused newsletter and educational publication. The Services include:

• A free newsletter and publicly available content on the Site;
• PRO, a paid membership providing access to the members-only platform, including the interview, paper, code, job, and pulse trackers, roadmaps, the code vault, interactive articles, and ad-free issues;
• Sponsored placements within the newsletter, each clearly identified as sponsored.

We aim to publish weekly but do not guarantee the frequency or availability of any content or feature. We may change, suspend, or retire any feature of the Services at any time, with or without notice.

3. Accounts and Registration

Certain features of the Services require you to create an account. When you do, you agree to:

• Provide accurate, current, and complete information, and maintain and promptly update that information;
• Keep your account credentials confidential and not share them with any third party;
• Notify us promptly, by emailing edwin@aibutsimple.com, of any unauthorized access to or use of your account.

An account belongs to a single individual. You are responsible for all activities that occur under your account. We may suspend or terminate your account if we believe, in our reasonable discretion, that you have violated these Terms or that doing so is necessary to protect the Services or other users.

4. Subscriptions, Payment, and Refunds

4.1 Plans and Pricing

PRO is offered at USD $12 per month, or USD $10 per month billed annually. Pricing, billing frequency, and the scope of paid features are disclosed at the point of purchase and may be updated from time to time.

4.2 Billing and Automatic Renewal

Paid memberships are billed in advance on the applicable monthly or annual cycle and are processed by our third-party payment processor. Your membership renews automatically at the current rate unless you cancel before the end of the billing period then in effect, and you authorize our payment processor to charge your stored payment method for each renewal. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until that date.

4.3 Refund Policy

You may request a full refund of your first payment within seven (7) days of your initial sign-up by emailing edwin@aibutsimple.com with the subject line “Refund Request.” After that window, payments, including renewal charges, are non-refundable except where applicable law requires otherwise.

4.4 Price Changes

We may change membership pricing at any time. If a change applies to your existing membership, we will provide notice at least fourteen (14) days before the change takes effect for your next billing period. Continuing your membership after a price change takes effect constitutes acceptance of the new price.

4.5 Taxes

You are responsible for all applicable taxes associated with your purchase of a paid membership, unless we are required by law to collect them on your behalf.

5. Acceptable Use

You agree not to:

• Use the Services for any purpose that is unlawful, fraudulent, infringing, or harassing;
• Share your account credentials or otherwise provide access to paid content to any person who does not hold a membership;
• Reproduce, duplicate, copy, sell, resell, or redistribute any portion of the Services or their content without our express written permission;
• Access, copy, or extract content from the Services by automated means, including robots, scrapers, and crawlers, without our prior written permission;
• Bypass or attempt to bypass any security, authentication, or access-control measure of the Services;
• Introduce viruses, malware, or other harmful code, or take any action that could disable, overburden, or impair the Services or interfere with another party's use of them;
• Impersonate another person or misrepresent your affiliation with any person or organization;
• Use the Services or any content obtained from them to train, fine-tune, or otherwise develop a machine learning or artificial intelligence model without our prior written permission.

6. Intellectual Property

6.1 Our Content

The Services and all content made available through them, including text, graphics, illustrations, logos, software, and the selection and arrangement of the Services (collectively, the “Content”), other than third-party content, are owned by AI, But Simple or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and view the Content for your personal, non-commercial use. You may quote brief excerpts of the Content with attribution and a link back to the source. You may not republish any issue or article in full without our prior written permission. No other right or license is granted, whether by implication, estoppel, or otherwise.

6.3 Feedback

If you submit suggestions, corrections, ideas, or other feedback about the Services, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use that feedback for any purpose, without any obligation to you. We will not attribute feedback to you by name without your consent.

7. Copyright Complaints

If you believe that any content on the Services infringes your copyright, please send a notice by emailing edwin@aibutsimple.com with the subject line “Copyright Notice.” Your notice must include: (i) identification of the copyrighted work claimed to have been infringed; (ii) identification of the allegedly infringing material and its location on the Services; (iii) your contact information; (iv) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (v) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

8. Third-Party Content and Data Sources

The trackers and other features of the Services aggregate information from public sources, including academic papers, code repositories, job boards, and company pages. We work to keep figures accurate and attributed, but we do not warrant that any third-party data presented through the Services is complete, current, or error-free. The Services may also contain links to third-party websites and services that we do not control; your use of third-party services is subject to their own terms and policies, and we are not responsible for their content or practices.

9. No Professional Advice

THE SERVICES AND ALL CONTENT ARE PROVIDED FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL, CAREER, FINANCIAL, LEGAL, OR OTHER ADVICE. NOTHING IN THE SERVICES CONSTITUTES A GUARANTEE OF ANY EMPLOYMENT, INTERVIEW, OR OTHER OUTCOME. YOU SHOULD CONSULT A QUALIFIED PROFESSIONAL BEFORE MAKING ANY DECISION BASED ON INFORMATION PROVIDED THROUGH THE SERVICES, AND YOU USE SUCH INFORMATION AT YOUR OWN RISK.

10. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AI, BUT SIMPLE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Termination

You may stop using the Services, unsubscribe from the newsletter, and cancel or delete your account at any time. We may suspend or terminate your access to the Services, with or without notice, if we believe you have violated these Terms. A membership terminated for a violation of Section 5 is not eligible for a refund. Upon termination, the provisions of these Terms that by their nature should survive termination (including Sections 6, 9, 10, 11, 13, and 15) will survive.

13. Governing Law and Dispute Resolution

Before bringing a formal proceeding, you and AI, But Simple agree to first attempt to resolve any dispute arising out of or relating to the Services or these Terms informally for at least sixty (60) days, beginning when you submit a written description of the dispute by emailing edwin@aibutsimple.com with the subject line “Dispute Notice.”

These Terms and any such dispute are governed by the laws of Canada, without regard to conflict of laws principles and subject to any mandatory consumer protection laws of your place of residence. Subject to the foregoing, the courts of that jurisdiction will have exclusive jurisdiction over any dispute that is not resolved informally.

14. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the Site, updating the Effective Date above, and notifying members before the changes take effect. Using the Services after revised Terms take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and AI, But Simple regarding the Services and supersede all prior agreements and understandings.
• Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely, including to a successor entity formed to operate the Services.
• Force majeure. We will not be liable for any failure or delay in performance caused by events beyond our reasonable control.
• Notices. Notices to us must be sent by emailing edwin@aibutsimple.com. Notices to you may be sent to the email address associated with your subscription or account, or by posting on the Site.
• Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
